Florida Comparative Negligence and Motor Vehicle Accidents

“I was injured in a motorcycle accident. The police officer said that I was partially to blame. I disagree. Can I still receive compensation for my injuries?”

This is common in motorcycle accidents but fault can also be a problem in all motor vehicle accidents. First, the police officer’s finding of fault is not always true. The officer is basing his or her findings on the position of the vehicles and the statements of the drivers. However, vehicles are often moved in minor accidents to avoid traffic backups; therefore, the officer must then rely on the drivers’ statements which may contradict each other. […]

Distracted Driving Is the Cause Of Most Car Accidents

Distracted driving is quickly becoming one of the worst epidemics on our country’s roads. The Virginia Tech Transportation Institute published a study claiming that distractions cause the most car accidents. This is despite the numerous programs and initiatives by agencies on the state and federal level to raise awareness of the dangers of driving while distracted.

The three-year study entitled the Second Strategic Highway Research program focused on more than 3,500 drivers between the ages of 16 and 98 years. The drivers allowed researchers to install video cameras in their vehicles to follow them as they drove. The researchers also tracked various factors including speed and location as part of the study. After analyzing 900 motor vehicle crashes, researchers concluded that drivers were distracted in 68 percent of the crashes. […]

What are the Common Injuries in a Motor Vehicle Accident?

While some motor vehicle accidents may only involve property damage, most accidents involve some degree of bodily injury. Regardless of the severity of your injuries, you should always seek medical attention following a motor vehicle accident. Some injuries (i.e. closed head injury) may not be easily identified immediately following an accident. Even if you do not need emergency medical attention, it is always in your best interest to follow up with your primary care physician after being involved in a car crash. […]

Boca Raton Resident Dies in Motorcycle Accident

All Florida motor vehicle accidents are inherently dangerous for those involved. However, when one of the vehicles in the crash is a motorcycle, the rider of that bike is at a far greater danger of serious injuries or even death. This is because motorcycles are considerably lighter than most other vehicles—especially trucks and SUVS—and the rider does not have a protective auto body or other safety features (such as airbags) to protect them. Unfortunately, motorcycle riders often get ejected and seriously hurt when they are involved in crashes. […]
