Tragic Accident Claims Life of Boca Raton Landscaper
News reports state that a man believed to be in his 20s died at a local hospital after being pulled from underneath a lawnmower on Sound Parkway in Boca Raton.
The landscaper was trapped under a lawnmower that rolled into the canal. Emergency teams pulled the man from under the lawnmower and he was rushed to the hospital but he did not survive his injuries. It is not known what caused the incident. Occupational Safety and Health Administration (OSHA) officials are investigating the accident. Depending on the details of the case, the victim’s family may be entitled to workers’ compensation benefits or compensation under Florida’s personal injury laws.
Florida’s Workers’ Compensation Laws
When a family member is injured or killed on the job, Florida’s workers’ comp laws provide benefits for the injured worker or his family, in the event of a death. While the process of receiving workers’ comp benefits should be easy and straightforward, injured workers and their families often experience difficulty receiving the benefits they are entitled to receive by law.
Insurance companies for employers in Florida are known to fight workers’ comp claims, especially in cases like this where the details of the accident are unknown. These unnecessary denials and delays cause financial and emotional stress for workers and their families. An experienced Boca Raton workers’ comp attorney can help you fight insurance companies that do not pay benefits in a timely manner.

Why Do I Need A Workers’ Compensation Attorney Who Understands Personal Injury Law?
The tragic accident that claimed the life of this young man is an example of why a family should hire a workers’ compensation attorney who also understands personal injury laws. The details of the accident that resulted in this man’s death are unknown. The workers’ compensation insurance carrier may try to deny the claim by alleging the accident was not related to the man’s job duties. This may or may not be a valid allegation.
An attorney who understands both workers’ comp laws and personal injury laws can perform an independent investigation to determine how a workplace accident happened. If the workplace accident occurred due to the fault of a third party, the victim and/or the family may have a third-party claim. If this is the case, it is important to gather and preserve evidence to prove fault. If a third party did something to cause the accident, the third party is liable for damages.
It is important to determine whether a workplace injury includes a third party claim because third-party claims can result in additional compensation. For example, if you are injured using a tool at work, you are entitled to workers’ compensation benefits provided you were performing a task within the scope of your employment. However, if the tool has a defect that made it dangerous to use, you may have a claim against the third party responsible for the defect. This third party claim can provide compensation that is not available in a workers’ compensation claim.
