We have that one outfit and that favorite pair of shoes that we love to pull out on a special occasion or a well-deserved vacation. Then we hesitate to try to decide if we truly want to wear that outfit or those shoes, so we rummage through the closet to find something else. The July 4th holiday is known for some of the epic parties of the year. We must account for other activities planned during the Independence holiday and pack accordingly. Then, let’s not forget the million and one things we need for our children or animals. Have you noticed the trend? What we do not need is an overloaded car that can cause an accident during our Fourth of July road trip. […]
Because more children will be on the roads riding their bicycles in just a few weeks, our attorneys feel it is an appropriate time to remind motorists and parents to take steps to protect their children from the risk of bicycle accidents. As school becomes a distant memory and the days grow longer, more children pull out their bicycles to spend the beautiful summer days riding from one friend’s house to another or from their home to the park. Bicyclists face an increased risk of being injured in a traffic-related accident because of distracted drivers, road debris, slick surfaces, traffic, and other hazards. However, when we increase the number of bicycle riders on our roads each summer, we increase the risk of a bicycle accident. […]
Florida Comparative Negligence and Motor Vehicle Accidents
“I was injured in a motorcycle accident. The police officer said that I was partially to blame. I disagree. Can I still receive compensation for my injuries?”
This is common in motorcycle accidents but fault can also be a problem in all motor vehicle accidents. First, the police officer’s finding of fault is not always true. The officer is basing his or her findings on the position of the vehicles and the statements of the drivers. However, vehicles are often moved in minor accidents to avoid traffic backups; therefore, the officer must then rely on the drivers’ statements which may contradict each other. […]
Distracted Driving Is the Cause Of Most Car Accidents
Distracted driving is quickly becoming one of the worst epidemics on our country’s roads. The Virginia Tech Transportation Institute published a study claiming that distractions cause the most car accidents. This is despite the numerous programs and initiatives by agencies on the state and federal level to raise awareness of the dangers of driving while distracted.
The three-year study entitled the Second Strategic Highway Research program focused on more than 3,500 drivers between the ages of 16 and 98 years. The drivers allowed researchers to install video cameras in their vehicles to follow them as they drove. The researchers also tracked various factors including speed and location as part of the study. After analyzing 900 motor vehicle crashes, researchers concluded that drivers were distracted in 68 percent of the crashes. […]
What are the Common Injuries in a Motor Vehicle Accident?
While some motor vehicle accidents may only involve property damage, most accidents involve some degree of bodily injury. The injuries you sustain in a motor vehicle accident can vary greatly depending on several factors such as were you riding a motorcycle; did a semi-truck cause the accident; and, how fast were the cars traveling the time of the crash.
Regardless of the severity of your injuries, you should always seek medical attention following a motor vehicle accident. Some injuries (i.e. closed head injury) may not be easily identified immediately following an accident. Even if you do not need emergency medical attention, it is always in your best interest to follow up with your primary care physician after being involved in a car crash. […]
What Can A Boca Raton Personal Injury Attorney Do To Help Me?
An insurance adjuster will tell you that a personal injury attorney cannot do anything that you cannot do yourself to settle your accident claim. Some adjusters may go as far as to tell you that a personal injury attorney will only charge a high fee for doing the same work so that you receive less money for your accident claim.
What you must remember is that the insurance adjuster is not looking out for your best interest. The insurance adjuster’s job is to pay you as little as possible to settle your accident claim. Insurance companies are in business to make money; therefore, paying you for your accident claim is not in the insurance company’s best interest. The adjuster works for the insurance company — the adjuster does not work for you. […]
Some traffic accidents do not result in injuries or they result in minor injuries that heal in a few weeks. However, some traffic accidents result in severe, traumatic injuries that require hospitalizations, surgeries, and physical therapy. During recovery, an accident victim may be unable to work due to his or her injuries. This […]
When you are injured in an accident, you suffer a variety of different types of damages. Non-economic damages include loss of enjoyment of life, physical pain, permanent disability, scarring, mental anguish, and emotional suffering. Economic damages include your medical expenses, property damage, lost wages, transportation costs, and other out-of-pocket expenses related to your injury and your recovery. The non-economic damages are impossible to fully compensate because a monetary award can never undo the pain and suffering you experience because of a personal injury.
However, you are entitled to recover full compensation for your economic losses in a personal injury claim. The insurance company for the other person understands you are probably suffering a financial crisis if you are out of work due to your injury. The insurance adjuster may try to offer a low settlement figure to entice you to accept the offer so you can receive money right now. Do not fall for this tactic — discuss your claim with an experienced Boca Raton personal injury attorney before you agree to any settlement. You are entitled to be fully compensated for your lost wages and other economic damages. […]
