Florida Comparative Negligence and Motor Vehicle Accidents

“I was injured in a motorcycle accident. The police officer said that I was partially to blame. I disagree. Can I still receive compensation for my injuries?”

This is common in motorcycle accidents but fault can also be a problem in all motor vehicle accidents. First, the police officer’s finding of fault is not always true. The officer is basing his or her findings on the position of the vehicles and the statements of the drivers. However, vehicles are often moved in minor accidents to avoid traffic backups; therefore, the officer must then rely on the drivers’ statements which may contradict each other. […]

Even if you do not need emergency medical attention, it is always in your best interest to follow up with your primary care physician after being involved in a car crash. […]

What Can A Boca Raton Personal Injury Attorney Do To Help Me?

An insurance adjuster will tell you that a personal injury attorney cannot do anything that you cannot do yourself to settle your accident claim. Some adjusters may go as far as to tell you that a personal injury attorney will only charge a high fee for doing the same work so that you receive less money for your accident claim.

What you must remember is that the insurance adjuster is not looking out for your best interest. The insurance adjuster’s job is to pay you as little as possible to settle your accident claim. Insurance companies are in business to make money; therefore, paying you for your accident claim is not in the insurance company’s best interest. The adjuster works for the insurance company — the adjuster does not work for you. […]

Can I Recover Lost Wages In A Florida Personal Injury Claim?

When you are injured in an accident, you suffer a variety of different types of damages. Non-economic damages include loss of enjoyment of life, physical pain, permanent disability, scarring, mental anguish, and emotional suffering. Economic damages include your medical expenses, property damage, lost wages, transportation costs, and other out-of-pocket expenses related to your injury and your recovery. The non-economic damages are impossible to fully compensate because a monetary award can never undo the pain and suffering you experience because of a personal injury.

However, you are entitled to recover full compensation for your economic losses in a personal injury claim. The insurance company for the other person understands you are probably suffering a financial crisis if you are out of work due to your injury. The insurance adjuster may try to offer a low settlement figure to entice you to accept the offer so you can receive money right now. Do not fall for this tactic — discuss your claim with an experienced Boca Raton personal injury attorney before you agree to any settlement. You are entitled to be fully compensated for your lost wages and other economic damages. […]
